Regulation and Future of Online Gaming in India: A Summary of the Proposed Bill

The Indian government has signaled its ambition to establish the nation as the “game development capital of the world” through the proposed Promotion and Regulation of Online Gaming Bill, 2025. This legislation is designed to bring much-needed structure and clarity to the burgeoning digital gaming sector.


Key Regulatory Framework

The central mechanism of the proposed legislation is the establishment of a national body, the ‘Online Gaming Authority’. This authority would be responsible for regulating the digital gaming landscape across the country, aiming to create a consistent regulatory environment and address inconsistencies that currently exist across various state laws.


Differentiating Games: Skill vs. Chance

One of the primary goals of the Bill is to clearly delineate between different types of online games, resolving the long-standing “grey area” that operators have exploited, particularly concerning the difference between games of skill and games of chance.

The Bill essentially divides the sector into two categories for regulatory purposes:

  1. ‘Safe’ Online Games (Promoted): This category includes e-sports and online social games. These are considered beneficial, generally skill-based, and the government intends to actively support and encourage their development.
  2. Money-Based Games/Gambling (Restricted): The Bill aims to strictly regulate and crack down on platforms that facilitate online gambling or real-money games of chance, such as certain versions of poker or rummy. The government has expressed concern that these platforms often lure individuals with the false promise of quick, large payouts, leading to significant financial and emotional distress, and potential addiction.

Enforcement and Protection

The legislation’s enforcement strategy focuses on taking strict action against the operators and developers of platforms that run illegal or unregulated real-money gaming activities, facilitate transactions for them, and commit fraud. Crucially, the government has indicated that individuals who merely play these games are viewed as victims of the fraudulent or addictive platforms and will not be subject to punishment under the new laws.

The push for this comprehensive regulatory framework is also a response to the significant prevalence of illegal online betting apps, which have been estimated to constitute a massive and rapidly growing unauthorized market in India.
